Abstract: Indigenous Peoples and the UN System

Indigenous Peoples were excluded from the UN System when it was created in the 1940's. In 1970, the Sub-Commission on the Prevention of Discrimination and Protection of Minorities recommended a comprehensive study of the problem of discrimination against Indigenous Peoples. In 1971, Jose Martinez Cobo was appointed Special Rapporteur for the study. His final report was submitted to the Sub-Commission during the years 1981-1984 (E/CN.4) Sub.2/1986/87 Add 1-4). It became the foundation of future UN work relating to Indigenous Peoples.

United Nations Special Rapporteur on the rights of indigenous peoples

Indigenous peoples across the world experience the consequences of historical colonization and invasion of their territories, and face discrimination because of their distinct cultures, identities and ways of life. In recent decades, the international community has given special attention to the human rights situations of indigenous peoples, as shown by the adoption of international standards and guidelines, as well as by the establishment of institutions and bodies that specifically target these peoples’ concerns. The rights of indigenous peoples are further promoted by international and regional human rights mechanisms. (See Indigenous Peoples).

In this context, the Commission on Human Rights decided to appoint in 2001 a Special Rapporteur on the rights of indigenous peoples, as part of the system of thematic Special Procedures. The Special Rapporteur’s mandate was renewed by the Commission on Human Rights in 2004, and by the Human Rights Council in 2007. See Mandate.

Relator especial sobre los derechos de los pueblos indígenas

Los pueblos indígenas de todas las regiones del mundo experimentan todavía las consecuencias de la colonización o de la conquista de las que fueron objeto históricamente, y son discriminados en razón de sus culturas e identidades diferenciadas y de sus formas tradicionales de vida. En las últimas décadas, la comunidad internacional ha concedido una especial importancia a la situación de derechos humanos de los pueblos indígenas, como se manifiesta en la adopción de normas y directivas internacionales, así como en el establecimiento de instituciones y órganos específicamente dedicados a estos pueblos. La defensa de los derechos de los pueblos indígenas ha sido también asumida por los mecanismos internacionales y regionales de derechos humanos (Véase Pueblos Indígenas).

En este contexto, la Comisión de Derechos Humanos decidió nombrar en 2001 un Relator Especial sobre la situación de los derechos humanos y libertades fundamentales de los indígenas, como parte del sistema de procedimientos especiales de la Comisión. El mandato del Relator Especial fue posteriormente renovado por la Comisión de Derechos Humanos, en 2004y por el Consejo de Derechos Humanos en 2007. Véase mandato.

Professor Rodolfo Stavenhagen is the first United Nations Special Rapporteur on the situation of human rights and fundamental freedoms of Indigenous people. He was appointed by the UN Commission on Human Rights in 2001 and his mandate is due to end in 2007. After six years of work, it was time to reflect on the mandate and the implementation of his recommendations.
